The Democratic Alliance (DA) has urged the Provincial Government to urgently rectify the unlawful appointment of Nelson Mandela Bay’s Acting Executive Director for Safety and Security.
Shadrack Sibiya has been serving as Acting Executive Director of Safety and Security since mid-2024.
The Municipal Systems Act provides that an acting appointment may only be made for a period of three months, which may, under exceptional circumstances, be extended by a further three months. The maximum permissible duration for such an appointment is therefore six months.
Sibiya has clearly been acting unlawfully in the position of Acting Director of Safety and Security.
I have written to the MEC for Cooperative Governance and Traditional Affairs (CoGTA), Zolile Williams, warning him to remove Sibiya, as the extensions of his contract beyond the initial term is in contravention of the Municipal Systems Act. Consequently, any decisions taken by him must be declared null and void. I have also asked MEC Williams to conduct a review of the unlawful actions taken by the Metro in extending Sibiya’s stay as Acting Executive Director.
The absolute indifference shown by the ANC/EFF coalition of chaos to the laws of the country now places the municipality at legal risk if Sibiya’s decisions are challenged in a court of law.
The imploding ANC and its coalition cronies have brought this City to the brink of collapse.
But in the upcoming Local Government Elections the people the Metro can remove them and install a DA government focused on services, safety and jobs. A DA government that will get Nelson Mandela Bay working again.
